PLEASE READ THESE TERMS OF SERVICE (“TERMS”) CAREFULLY BEFORE USING ANY WEBSITE, APPLICATION, SUBDOMAIN, PLATFORM, DIGITAL SERVICE, OR ONLINE PROGRAM OPERATED BY FARALDO HOLDINGS LLC AND JOSE A. DEJESUS (COLLECTIVELY, “THE WILD CRUST,” “WE,” “US,” OR “OUR”) THAT LINKS TO THESE TERMS, INCLUDING WWW.THEWILDCRUST.COM, CORP.THEWILDCRUST.COM, AND ANY STORE-LEVEL SUBDOMAINS (TOGETHER, THE “TWC ONLINE SERVICES”).
BY ACCESSING, DOWNLOADING, OR USING ANY OF THE TWC ONLINE SERVICES, YOU AFFIRM THAT YOU ARE ABLE AND LEGALLY COMPETENT TO ACCEPT AND AGREE TO THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS OR OUR PRIVACY POLICY, YOU ARE NOT PERMITTED TO ACCESS OR USE THE TWC ONLINE SERVICES.
These Terms constitute a legally binding agreement between you and The Wild Crust. We recommend that you print or save a copy of these Terms for your records.
Certain features, services, or programs offered through the TWC Online Services—including loyalty promotions, stored value cards (“Wild Cards”), sweepstakes, mobile tools, or store-level offerings—may be governed by additional terms and conditions presented to you at the time of participation.
If there is a conflict between these Terms and additional terms, the additional terms will control, unless they expressly state otherwise.
We may update or modify these Terms at any time. Any material changes will be communicated by posting a notice on the TWC Online Services. If you maintain an account, we may notify you by email.
Your continued use of the TWC Online Services after any changes constitutes your acceptance of the revised Terms. If you do not agree, you must discontinue use immediately.
Changes to the Dispute Resolution / Arbitration provisions will not apply to disputes for which either party had actual notice prior to the effective date.
The TWC Online Services are not intended for children under the age of 13.
YOU MUST BE AT LEAST 13 YEARS OLD to access or use the TWC Online Services.
Users between 13 and 18 years old may only use the TWC Online Services with parental or legal guardian consent. If you permit your minor child to use the TWC Online Services, you agree to these Terms on their behalf.
Some features require account registration. By creating an account, you agree to:
Create only one account per individual
Provide accurate, current, and complete information
Maintain and promptly update account information
Keep your password confidential
Notify us immediately of any unauthorized use
You are responsible for all activities that occur under your account.
We may, at any time and without notice, suspend or terminate your account for violation of these Terms or for any conduct harmful to The Wild Crust, its users, or partners.
The TWC Online Services and all related materials, content, design, and software are owned by The Wild Crust and provided to you for personal, non-commercial use only.
You may not:
Copy, reproduce, modify, distribute, or publicly display any portion of the TWC Online Services
Create derivative works
Harvest content or data for commercial use
Reverse-engineer or attempt to extract source code
All rights not expressly granted are reserved.
Your use of the TWC Online Services is governed by our Privacy Policy, which explains how The Wild Crust collects, uses, and shares your information. By using the TWC Online Services, you consent to our data practices consistent with the Privacy Policy.
You agree not to use the TWC Online Services:
For unlawful or prohibited purposes
To harm or attempt to harm any person or entity
To interfere with the operation of our systems
To upload, post, or transmit defamatory, abusive, obscene, infringing, or otherwise objectionable content
To attempt unauthorized access to our networks or accounts
To scrape, mine, or extract data for competitive purposes
To reproduce or commercially exploit the TWC Online Services
We reserve the right to terminate access, remove content, or pursue legal action if we reasonably believe you have violated these Terms.
Products, pricing, and availability may vary by location. Each store—including those in Alaska, Hawaii, and future markets—may offer different menu items, pricing, or promotions.
We reserve the right, without notice, to:
Modify or discontinue products
Adjust pricing
Limit quantities
Change store hours or availability
Online listings, menus, or promotions may not reflect real-time availability.
Wild Cards may be offered as physical or electronic stored-value instruments. Unless otherwise noted:
Wild Cards do not expire
No fees apply
Cards may be used at participating Wild Crust locations
Card value is non-refundable except where required by law
Lost or stolen cards may not be replaced unless registered
Purchase or use of a Wild Card constitutes acceptance of applicable terms.
All hiring for The Wild Crust is managed through Moonlight Direct, an external staffing and contractor platform.
By following employment links or submitting information through Moonlight Direct, you acknowledge that all employment terms, conditions, and processes are governed exclusively by Moonlight Direct’s systems and policies, not The Wild Crust.
The Wild Crust does not guarantee employment, interview selection, or application status updates.
All trademarks, service marks, trade dress, logos, product names, and branding used on the TWC Online Services—including The Wild Crust™, Half Baked. Fully Caffeinated™, and associated visual designs—are owned by or licensed to Faraldo Holdings LLC and Jose A. DeJesus.
You may not use our marks without prior written permission.
All site content, software, and media are protected by copyright, trademark, and other intellectual property laws.
If you believe material on the TWC Online Services infringes your copyright, send a DMCA-compliant notice to our designated agent:

Knowingly submitting false claims may expose you to liability under federal law.

We are not responsible for:
Content
Security practices
Service quality
Pricing differences
Delivery errors or contractor actions
Your access and use of third-party services are governed by their terms and policies.
THE TWC ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
To the fullest extent permitted by law, The Wild Crust disclaims all warranties—express or implied—including:
Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy, reliability, or availability of the services
We do not guarantee:
Uninterrupted access
Error-free functionality
Security against viruses or harmful components
Real-time accuracy of menus, pricing, or store information
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WILD CRUST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Lost profits
Lost data
Service outages
Delays, errors, or miscommunications
Device failure
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 OR THE AMOUNT YOU PAID US, WHICHEVER IS LESS.
Nothing in these Terms restricts liability for:
Intentional misconduct
Fraud
Willful negligence
Personal injury where such limitation is not permitted by law
You agree to indemnify, defend, and hold harmless The Wild Crust and its owners, partners, employees, contractors, affiliates, and agents from any claims arising out of:
Your misuse of the TWC Online Services
Your violation of these Terms
Your infringement of third-party rights
This provision does not require indemnification for our sole negligence or willful misconduct.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
By using the TWC Online Services, you and The Wild Crust agree that:
All disputes arising out of or relating to these Terms or the use of the TWC Online Services shall be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA).
Arbitration shall occur in Anchorage, Alaska, unless otherwise required by law.
You and The Wild Crust waive the right to a jury trial.
You and The Wild Crust waive any right to participate in a class action, collective action, or representative action.
You may opt out of this arbitration agreement within 30 days of first using the TWC Online Services by emailing:

Include name, contact information, and a clear statement opting out.
If you do not opt out, this arbitration agreement applies to you.
These Terms are governed by the laws of the State of Alaska, without regard to conflict-of-law principles.
If arbitration is deemed unenforceable, disputes shall be brought exclusively in the state or federal courts located in Anchorage, Alaska, and both parties consent to personal jurisdiction there.
We may terminate or suspend your access to the TWC Online Services at any time, without notice, for any conduct that violates these Terms or is otherwise harmful.
Sections that, by their nature, should survive termination—including arbitration, IP rights, indemnification, and limitation of liability—shall survive.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
